Colorado Fugitive From Justice & Extradition - Denver Criminal Defense Lawyers

Fugitive from Justice Lawyer in Denver

What is a Colorado Fugitive from Justice involving a warrant?  It is the same thing as a California Fugitive from Justice or a Texas Fugitive from Justice.  The U.S. Constitution provides that "A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime."  Article IV, Section II.

Extradition in Colorado - Defense Attorneys and Judges Use the Uniform Criminal Extradition Act

This means that all states have a mutual obligation to return persons wanted by another (foreign) state for criminal prosecution, usually by warrant.  States have defined the procedures related to the return of fugitives under C.R.S. 16-19-104, the Uniform Criminal Extradition Act.  This act outlines what steps both states must take to ensure a fair transfer process.  Generally, this process is a series of specific steps the governors of each state must do before the forced transfer of a person from one sovereign state to another.  These steps are applicable to anyone wanted for Extradition (Extradite) and prosecution in Denver, Jefferson and Douglas County.

Arapahoe and Adams County - What is a Fugitive from Justice?

"Fugitives" are merely people wanted in another state.  Fugitives did not necessarily know that they were wanted in another state before they left Arapahoe or Adams County, Colorado.  They were not necessarily hiding out.  They are simply accused by a foreign state, of a more serious crime like felony Theft or Assault.  They are not necessarily guilty of anything, but must be brought to the foreign state in an orderly manner to face the charges and determine their guilt or innocence.

Defense Attorneys Can Help a Fugitive with Extradition Problems

As a criminal attorney / lawyer, I work with clients who are fugitives in other states.  Recentlly, I've worked with clients who were in California and Texas when they were arrested without notice under a warrant, to return to Colorado for crimes allegedly committed here.  My clients were forced to return here and one was brought back on a lengthy trip from Texas in a van with other inmates.  My California client was allowed to drive himself back to Colorado after I intervened with Courts in both California and Colorado.  I was able to get permission for my client to post a modest bond in California and return to Douglas County, Colorado.  This saved my client a two week trip in a crowded transport van, and thousands in restitution.

Colorado Extradition (Extradite) of fugitives involves the process of returning people to Colorado to face charges.  It also includes the return of someone in Colorado to another state.  There are many specific procedural requirements which I outlined in another recent blog related to Extradition and Governor's Warrants.

If you have been identified as a Fugitive from Justice for extradition, be smart, exercise your right to remain silent, and contact a criminal law specialist lawyer at the O'Malley Law Office today, at 303-731-0719. Together, we can protect your future.
