Denver County’s unlawful drug use law prohibits people from using controlled substances that aren’t prescribed to them for medical needs. CRS 18-18-404 defines unlawful drug use in the state of Colorado. You commit this drug offense in Denver, Cherry Creek, or Montbello if you:

  • use any controlled substance (with the exception of marijuana or marijuana concentrate),
  • unless it is dispensed via a person licensed and authorized to prescribe, administer, or dispense controlled substances

This applies to a variety of drugs including Anabolic steroids, Oxycontin, Vicodin, Codeine, Meth, Heroin, and Cocaine. In some cases, defendants can face the charge of unlawful possession of a controlled substance for having control over these drugs.

Punishment for Unlawful Use of a Controlled Substance

Unlawful use is a level 2 drug misdemeanor throughout Colorado. Earlier this year, the penalties for conviction changed. Now, defendants face the following:

  • up to 1 year of probation,
  • a maximum fine of $500,
  • possible incarceration of up to 4 months in county jail
