When we hear about Burglary in the news, there are underlying issues where the public is unaware. According to police reports, the man was told to drop the knife, ignored commands, advanced on the officer, and was then shot multiple times. Witnesses say the man appeared to be on drugs.
When I read stories like this, I’m reminded of how desperate people can do crazy things. While it is my job to defend people charged with crimes, I’m also concerned for the safety of innocent people. I am concerned that the trend of Colorado lawmakers is to disarm people from protecting themselves, and I am equally concerned with over-zealous prosecutors who will overcharge citizens in Douglas and Jefferson County in order to make get another notch in their belts.
If the above story was reported accurately, the suspect would certainly be charged with Attempted Burglary, but he would also be charged with several more serious crimes like Menacing (C.R.S. 18-3-206), and Assault on a Peace Officer, which is charged as First Degree Assault (C.R.S. 18-3-202).
