Charged With A Crime? It Doesn’t Mean You’re Guilty.

Warmer Weather, Alcohol Crimes on the Rise

<h1></h1>I am always amazed at the sudden increase in crimes we see with the warm weather. Each year, I try and figure out the connection, but can only guess it is alcohol use.  Does anyone know how much beer is sold in the average summer month compared to winter months?

Alcohol is at the heart of 60% of our warm weather cases in Denver and Arapahoe County, and we don’t just defend DUI cases.  Assault and Sex based crimes like Public Indecency, Indecent Exposure, and Invasion of Privacy for Sexual Gratification (peeping Tom) flourish in the summer months.  Alcohol causes people to feel less inhibited so they do stupid things.  Adult men and women need a “designated supervisor” in addition to a designated driver.

When the police or sheriff deputy in Douglas, Adams and Jefferson County show up at your party on a noise complaint, they will search people and interview many.  They are looking for evidence of other crimes, so always decline to be interviewed.  Yes, the truth can hurt you, so just be quiet.  Contrary to what most of my clients say, they do have something to hide!

Alcohol results in calls to the police for suspicious behavior, like someone passed out in their car at a light.  Don’t drive if you’ve had one drink.  That should be the rule, because many people are incapable of making wise choices once alcohol has entered their system.  DUI (Driving Under the Influence – 12 points) and DWAI (Driving While Ability Impaired – 8 points) charges are very likely if you put the key in your car’s ignition.

Finally men and women make terrible decisions about sex once they’ve started drinking.  Every spring and summer, we are hired on cases where the morning after, a woman says she was incapable of giving consent to sex because she was drunk.  This type of case will be charged as rape in Broomfield and Boulder County and men go to prison.  Men, unless you know a woman well, don’t engage in sex with her or you are at great risk of arrest.  Women often want to save face with family, friends or a boyfriend who are critical of her decision to have sex with you.
