Charged With A Crime? It Doesn’t Mean You’re Guilty.

Colorado Deputy District Attorneys (DAs) Can Get Their Feelings Hurt

Denver Sexual Assault on a Child Attorney

I recently defended a client from a Sexual Assault on a Child case, C.R.S. 18-3-405, where we won hands down.  The jury took under 30 minutes to decide the acquittal and the case was dismissed after the verdict was read.  As we almost always do, we then filed a Petition to Seal the Arrest and Criminal Record under C.R.S. 24-72-308, in Denver, Adams, Arapahoe and Douglas County. We never get an objection by the DA, yet in this case we did.  Someone’s feelings were hurt.

DA’s Do Not Always Do Their Homework

This case became a heated battle because it should never have been filed.  The DA simply did not know all the facts of the case and had not done her homework. She was too busy thinking every man is a sex offender and did not bother investigating motives to lie.  In this case, we discovered that the child had plenty of motive for lying and exposed these to the jury.  It seems it was the first time the DA had considered the possibility.

A Jefferson County Criminal Defense Lawyer’s Opinion: Where is the Pursuit of Justice

Young Deputy District Attorneys are given an awesome responsibility in deciding which cases to file and which to decline.  This Deputy DA has become proud and lost the foundation for her job – the pursuit of justice.  She is enamored with herself and feeling important in front of a jury. She only thinks how a win might make her look good to her peers.  The power entrusted to her has gone to her head and she no longer has the objectivity to do her job well.  She is motivated by her own selfish interests.

Over-Chargins Issue in Douglas County

I am concerned with how easy it is to manipulate government workers in Jefferson, Weld and Larimer County.  Police either want to look good to cute “victims” and ignore facts to please them, or they are so busy they just file charges with every accusation in order to get the case behind them quickly.  DA’s want to support police so they prosecute most anything passed on by police.  No one wants to do their job and investigate a case.  No one wants to take the risk of criticism if they make a mistake, so they file it all.

So, we have to aggresively defend everyone accused of a crime. Evidence spoils if not preserved and the memories of witnesses fade if not recorded.  We are in the business of protecting you.  We don’t care what the police think of us and we know the law better than they do.  If you have been charged with a crime, come in for a free consultation.  I think you will agree that no criminal defense team will care more for you.  Be smart, exercise your right to remain silent, and call us today at 303-731-0719.  Together, we can protect your future.
