Charged With A Crime? It Doesn’t Mean You’re Guilty.

Mom in Arvada Arrested for Child Abuse

On Behalf of | Oct 13, 2011 | Child Abuse |

A Mom in Arvada, Colorado has been arrested for Child Abuse for allegedly handcuffing her daughter while the two of them were in a disagreement. The daughter has alleged injuries to her wrists and a slight scratch on her face according to 9News.

In the Denver area and throughout Colorado, Child Abuse is a very serious issue. Taking the article at face value, the type of Child Abuse alleged will likely result in at least one misdemeanor charge of Colorado Child Abuse (C.R.S. 18-6-401). If convicted, the Mom could face a penalty of jail time, fines, counseling classes, and community service. Additionally, Social Services (Colorado Department of Human Services) might also file a dependency and neglect case against the mother. Child Abuse is an offense that the DA’s in Arvada, Castle Rock, Denver and other Colorado communities take very seriously.

Most important to take away from this story is that speaking with others about your case is not a good idea. It is easy to understand why you would speak out to the media about what happened. It might be because you don’t want everyone watching the news to think poorly of you, you want to tell your side of the story, or you want people to know the truth about what happened. We can all relate to these desires. However, a good criminal defense attorney is going to fight those battles for you. They are going to tell your side of the story and make sure that the truth of what happened is known.

When the police and District Attorneys are making a case against you, they will try to find every statement you have made and use it to their advantage. There is no indication that the Mom had spoken with an attorney or that her attorney was present while she was speaking to the media about her involvement in the incident. Because she spoke to the media without legal counsel, she could have seriously hurt her own defense.
