Charged With A Crime? It Doesn’t Mean You’re Guilty.

Couple Arrested on Child Abuse Charges

On Behalf of | Jun 24, 2011 | Child Abuse |

Child Abuse charges were investigated when Denver police were called to an apartment on a report that a couple’s infant son was not breathing. The child was taken to Swedish Medical Center, where he was later confirmed dead. The parents were arrested on Colorado Felony Child Abuse charges. C.R.S. 18-6-401.  According to CBS4, police and medical professionals determined there were multiple injuries to the three-month old child which occurred in different stages.

Both parents had been arrested multiple times over the past year, primarily for misdemeanor drug possession charges. The Denver County couple is now in custody on Felony Child Abuse charges, which could be amended to Child Abuse Resulting in Death, depending on the coroner’s cause of death determination.

Many times in Colorado on child injury cases, our clients are falsely accused or over charged.  Divorce proceedings are fertile ground for accusations of abuse by one spouse in an effort to prevent the other spouse from having access to children.  Other cases develop after Social Services makes a report to police following a cursory investigation.  Medical professionals, counselors, and teachers are all mandatory reporters in Colorado and furnish a wealth of referrals for Social Services.  One sad consequence is that parents in Jefferson and Arapahoe County are arrested and children are removed from homes on speculation of child abuse, where the actual cause of injury is truly accidental.

With any Child Abuse conviction, teachers and child care workers are permanently unemployable.  It is essential that an experienced criminal defense attorney employ experts, talk with witnesses and employ legal tools to save a career.  A recent client had 28 years of teaching experience and was slated to lose his career in Adams County over allegations of Child Abuse by a disgruntled student.  Fortunately, the jury found our client not-guilty after only 20 minutes of deliberation.
