Sexual Assault on a Child charges are being investigated in Douglas County, Colorado, against a dental assistant living in Castle Rock, Colorado (Douglas County). The Denver Post reported on January 28, 2011, that Roohalla Mobarez was arrested on five counts of Douglas County Colorado sexual assault on a child, and one count of Douglas County, Colorado sexual assault as a Pattern of Abuse.
According to the news release, four of the alleged victims are believed to be under the age of twelve. According to Colorado law, C.R.S. 18-3-401(2.5), it would have to be proven by the Douglas County District Attorney that Mr. Mobareaz committed two or more incidents of sexual contact involving a child upon the same victim, for him to be convicted of Sexual Assault on a Child, Patten of Abuse charge. The Sexual Assault on a Child charge only requires proof of one count of sexual contact with a child. As of the date of the Denver Post article, Mr. Mobarez was being held in the Douglas County, Colorado jail on a $75,000 bond.
The penalties for sexual assault charges are extreme, often requiring a lifetime prison sentence. This is referred to as “indeterminate sentencing”, where a Colorado defendant is given a minimum sentence, but no maximum. The practical effect of this sentencing structure is that the Colorado parole department can refuse parole and keep a defendant in prison for life. Other crimes such as burglary, felonly theft, and cocaine drug convictions would result in “determinate” sentences, where the defendant is sentenced to a maximum number of years.
