There are three names for the same sentencing option in Denver: Home Detention, In-Home Detention and House Arrest. Each of these involve serving your Arapahoe County Jail sentence at home, rather than at the jail. People often ask for Home Detention, but few get it. Home Detention in Jefferson County, Colorado and Douglas County, Colorado - What is House Arrest?

If you have a Jefferson County misdemeanor conviction by plea agreement or a guilty verdict after a jury trial, the judge may want to sentence you to incarceration of some type. One of the options he has is In-Home Detention - IHD. This involves you staying in your house for your sentence, rather than going to jail. Here, there is usually an electronic monitoring of you by an ankle bracelet which tells the court if you leave your house without permission. This sentencing option allows people with illnesses or children or elderly people at home to care for themselves or others during their sentence. While it is cheaper for the court to send you to your home, it is seen as an easy sentence which does not have much punitive or punishment power. Deterrence from future criminal activity is a major reason for a sentence and many courts simply feel this is not accomplished with a sentence to Douglas County House Arrest or In-Home Detention. Escape from Home Detention?  It is a Possible Crime.

In-Home Detention in Adams County - Who Gets House Arrest and Who Does Not?

Usually, only misdemeanor cases will qualify in Adams County, for House Arrest or In-Home Detention sentencing. A felony is considered too serious. Next, the level of culpability must be minimal. Doing something really harmful to another will result in a jail sentence. Finally, there must be a strong showing of societal need. Caring for children or elderly relatives is a good example. Otherwise, a judge will impose a county jail sentence. Also, someone with a criminal history of much size will never get In-Home Detention, since punishments are supposed to get more serious with each conviction.
