This usually occurs because the person who feels threatened knows that the person who is threatening them is armed with a gun. Police lose their common sense when a gun is allegedly involved. I have seen cases where the Lakewood Police or Castle Rock Police charge my client with Felony Menacing simply because he got into an argument and was open carrying his firearm.
