Charged With A Crime? It Doesn’t Mean You’re Guilty.

The State of Colorado has enacted several new firearms laws which will affect the self defense rights of all citizens of Colorado in counties like Arapahoe County, Jefferson, Douglas, Adams, and Denver. This overreaching by our state government will do much more harm than good for the people of this great state.

Let’s look specifically at the Magazine limits law. The law now makes it illegal to purchase or transfer a magazine for firearms which holds more than fifteen rounds of ammunition / bullets. Violation of this law is not a Felony like the Possession of a Weapon by Previous Offender state statute (C.R.S. 18-12-108). The law will not ban the use, possession, or transport of these type of magazines in Larimer, El Paso, or Weld County. Instead, the law will ban the sale of them. So, ex post facto law arguments, and seizure of property will not come into play in Colorado.

Some say that this law is a good thing for the people of Colorado. However, what right does the state have to infringe upon your own ability to protect your family? We have laws in Colorado that make it self-defense to a crime if you are acting in defense of yourself or others (Use of physical force in defense of a person, C.R.S. 18-1-704); this law is also known as Self Defense. If someone is harming you or another person, you have the right to stop them with a firearm. The magazine limitation will inhibit citizens from protecting themselves with a gun in Colorado.

Can most people connect a couple shots from a gun or firearm on a person when they have 15 rounds? I hope so. What about the Mom who is home alone at 3 o’clock in the morning and someone breaks into her home in Lakewood, Aurora, or Denver. With her pulse racing, she tries to protect her kids. She shoots a couple of intruders, but one still gets to her. Would she have been able to save her life and the lives of her children had she been carrying a few more rounds in the magazine? Probably.
