DAs, Courts, and Police - Rules Don't Apply

Apparently the rules that govern fair play in our Colorado criminal "justice" system do not apply to prosecutors and District Attorneys. In the world of DAs, Courts, and Police, it seems that it is perfectly fine for a District Attorney in Adams, Broomfield, or Denver County to walk into court on the day of a trial, hand defense counsel new evidence, and then have the gall to object to a reasonable continuance to assess the new evidence. Seriously.

As if that isn't bad enough, a judge recently actually considered NOT granting a continuance because the "victim" (not alleged victim, or even better "complaining witness") objected to the continuance. The alleged victim hides evidence and then objects to a continuance of the trial when that evidence is revealed on the day of trial. As if lying about a Domestic Violence crime (C.R.S. 18-6-800.3) somehow gives you special status.

As a defendant (and a defense attorney) some days it can feel like all of the cards are stacked against you. Because you are accused of a crime you are treated as guilty until proven innocent. If the evidence essentially comes down to he said/she said in an Assault (C.R.S. 18-3-204) or Harassment (C.R.S. 18-9-111) case in Weld and Larimer County, how can you prove that something didn't happen? There are many criminal cases like this where an angry ex, or significant other, is simply out for revenge. It is a shame that the police and District Attorneys are so willing to accommodate. They fear any criticism from anyone and are scared for their jobs.
