Sexual Assault - Colorado Springs Fire Volunteer: C.R.S. 18-3-402

A man who volunteered to fight this summer's Waldo Canyon Fire in Colorado Springs has been accused of sexually assaulting another volunteer (Sexual Assault, C.R.S. 18-3-402). The woman accusing this man says that the two went out for dinner and drinks with a group, and the two stayed at the bar alone after everyone left. They went back to their hotel together, which is where the assault is alleged to have occurred, and she believes that he drugged her sometime while they were at the bar. This man has been charged with class 4 felony sexual assault by the El Paso County District Attorney's Office.

Like many accusations of sexual assault, this story sounds like a case of "morning after regret" by someone who consents to sex while they are drunk. Unfortunately, it is very common for a person to be charged with sexual assault in Denver, Douglas, and Adams County even when the accusations stem from an intoxicated participant. One might think that "he said / she said" accusations would cause police and prosecutors to look at a case with a more critical eye before filing charges, but that is regrettably far from the truth. A person who is accused of sexual assault, or any other crime, is treated like they are guilty until proven innocent.

Being falsely accused of a sex offense is especially frightening because those charged are subject to harsh prison sentences and indeterminate sentencing. Additionally, being convicted of a sexually based offense means having to register as a sex offender (Sex Offender Registration) sometimes for a lifetime, as well as being restricted as to where you can live and work. The government has the power to completely ruin a person's life merely because someone they slept with regretted it afterward.

If you have been accused of sex assault or any other sex crime in Arapahoe, Jefferson, or Larimer County, we can help you fight these false allegations. At the O'Malley Law Office, we are experienced criminal defense attorneys who specialize in sex crime defense. These are complex cases, so if you are contacted by the police, be smart, exercise your right to remain silent and call us today at 303-731-0719. Together, we can protect your future.
