Symphony Violinist in Sexual Assault on a Child: C.R.S. 18-3-405

A Colorado Symphony violinist pleaded guilty in two cases involving Sexual Assault on a Child (C.R.S. 18-3-405). His employer, the Colorado Symphony Orchestra, fired him as a result of his plea although he had been a member of the orchestra for almost 20 years. The cases involved allegations he had inappropriately touched two of his daughter's friends during sleepovers. He pled guilty in Arapahoe County District Court, and was sentenced to 10 years to life and eight years to life, respectively, in Colorado's Sex Offender Intensive Supervision Probation program.

As this case illustrates, in Colorado jurisdictions including Denver, Arapahoe, and Adams County, sex offenses like Sexual Assault on a Child are subject to indeterminate sentencing. This is the reason this man is now serving two possible life sentences. If he violates probation, he will likely go to prison for an indeterminate sentence, including life. Based on his compliance with the harsh requirements of the Intensive Supervised Probation program of the Sex Offender Management Board (SOMB), this violinist will likely be at the mercy of the State until he dies.

Additionally, being convicted of a sexually based offense means having to register as a sex offender, sometimes for a lifetime, as well as being greatly restricted as to where you can live, work, and who you can be around. For example, you may not be able to stay in your home if it is near a park or a greenbelt. If you are a juvenile who is accused of sexually assaulting another child, you may not be able to attend public school.
