Charged With A Crime? It Doesn’t Mean You’re Guilty.

Cherry Creek, Colorado, Kidnapping Case

A man arrested for assaulting a woman in the parking lot of the Denver Cherry Creek Shopping Center was formally charged with Colorado kidnapping and other charges. The suspect is accused of stealing the woman’s car at gun point and forcing her into the trunk. According to FOX31, he is also a suspect in the murder of a 73 year old man.  While not yet formally charged with the murder, the suspect currently faces two counts of second degree kidnapping, aggravated robbery, first degree aggravated motor vehicle theft, and Possession of a Weapon by a Previous Offender. (C.R.S. 18-3-302, C.R.S. 18-4-302, C.R.S. 18-4-409, C.R.S. 18-12-108).

The counts of second degree kidnapping will likely be charged as a class 2 felony, because the person kidnapped is a victim of robbery. The defendant is facing “Aggravated” Robbery rather than “Simple” Robbery, because the defendant is alleged to have “knowingly” put the person robbed in fear of death or bodily injury by the use of force, threats, or intimidation with a deadly weapon.
