Petty Theft to Felony Possession of Burglary Tools

Most people are unaware that a Petty Theft charge can quickly turn into a Felony Burglary case. In Denver, Castle Rock, Parker, and Northglenn, Petty Theft occurs when an individual takes another's property into their own possession. This could be a pack of gum from a supermarket, a pair of jeans from a department store, or a pair of shoes from a store in the Colorado Mills Mall. Possession of Burglary Tools, C.R.S. 18-4-205, states that if someone is in possession of tools or equipment that are commonly used to commit a burglary, then that person is guilty of a class 5 felony. These could be explosives, instruments that are adapted for stealing items, or even a pair of scissors that would be used to cut sensors off merchandise.

A class 5 felony carries a sentence of 1 - 3 years in prison and 2 years of mandatory parole. The District Attorney can also push for fines of up to $100,000.00. Without a criminal lawyer in the Denver area, you could be facing the maximum sentence with prison and fines.
