Careless Driving

Colorado Careless Driving Attorney

It's tempting to speed a little in your new car, take turns a little too sharp, cut around other vehicles with too narrow a margin and sometimes just to have fun on the road. What seems like acceptable behavior to some can constitute careless driving in Denver and Jefferson County. And careless driving doesn't happen with just motor vehicles; it can occur on a bicycle, electrical-assisted bicycle or low-power scooter. Section 42-4-1402, C.R.S.

The Definition for Colorado Careless Driving

C.R.S. 42-4-1402 - Careless Driving - is defined as:

"A person who drives a motor vehicle, bicycle, electrical assisted bicycle, or low-power scooter in a careless and imprudent manner, without due regard for the width, grade, curves, corners, traffic, and use of the streets and highways and all other attendant circumstances, is guilty of careless driving."

Real world examples of Careless Driving in Arapahoe and Douglas County include a police officer pulling you over for not paying attention or driving slower with snowy / icy roads when adverse weather conditions exist. Another example would be you falling asleep at the wheel and driving into a ditch.  There are many factors that affect a careless driving conviction, but at the heart of an accusation is the act of driving a motor vehicle and the state of mind in "disregard" of or "without due regard" for safety. While not truly committing a "crime," by driving careless in Adams and Elbert County, one is being negligent.

Sentencing for the Offense of Colorado Careless Driving:

Any person found guilty of driving carelessly, commits a Class 2 misdemeanor traffic offense, and 4 points against your Department of Motor Vehicles drivers license. If driving carelessly results in serious bodily injury to another, then such person commits a Class 1 misdemeanor traffic offense. If driving carelessly is the proximate cause of death to another (including an unborn fetus), then such person commits a Class 1 misdemeanor traffic offense, with a 12 point DMV penalty.
