Assault charges can be simple misdemeanors or, with the presence of injury or a weapon, felonies. Assaults against police officers involve mandatory jail or prison. In many cases, people charged with crimes were simply trying to defend themselves or someone else. Under Colorado law, self-defense is a permissible affirmative defense and really tips the balance of the case in favor of the defense. Other assaults are the result of a pushing match which should not be charged so seriously. Frequently, alcohol is involved and can be both a mitigator and an aggravator.

The government has several elements which they must prove in order to win an assault case, including whether you knowingly or intentionally caused bodily injury to another person. “Bodily injury” is defined as “pain”. Assaults in Colorado typically fall into one of three classes:

Assault in the First Degree - Felony
Assault in the Second Degree - Felony
Assault in the Third Degree - Misdemeanor

Don’t defeat your case by speaking to the police. Many defenses are unusable once our client has spoken with the police. The police know this and will appear anxious to learn the truth and be very reasonable. They are acting. They want to disarm you and make you feel comfortable speaking with them. Really, they are trying to build a case against you and to get you to make admissions which will later be used against you. At the conclusion of your talk with them, they will put you under arrest. So, don’t make any statements to the police. A jury will never be told you exercised your constitutional right to remain silent.

Assault charges often accompany other charges like menacing, robbery, harassment, trespass, and domestic violence. Don’t be discouraged by this practice. In many instances the government knows they cannot prove charges, but include them in an effort to persuade you to enter into a plea agreement. We don’t fall for this tactic and are able to sift out the charges which the government may be able to prove vs. those which are “add ons”.
